Living Wills

Are you concerned that you may one day be unable to make a decision about the kind of medical treatment you receive, or that steps may be taken to prolong artificially your life?

If you are concerned that there may come a day when you are seriously ill and a decision will need to be made about receiving treatment that you may not want, for example to prolong artificially your life, then a Living Will is the place where you can set out your views and know that they will be taken account of at the appropriate time.

A Living Will is not actually a will at all – although it is often referred to as one. It is, instead, a statement which sets out your wishes as to how you would, or would not, like to be treated in the event that you are unable to make decisions about your treatment at the some point in the future. It will only come into effect if you are no longer able to make decisions yourself. It can be used so that you can let others know:

    • the circumstances under which you would not want to receive life-sustaining medical treatment if you became seriously ill in the future and were incapable of making your own healthcare decisions,
    • whether you would want to be treated by means of artificial feeding, mechanical ventilation, antibiotic therapy and resuscitation.

To be valid, it must comply with the various legal requirements set out in the Mental Capacity Act 2005 and, in particular, must be signed by you whilst you have mentally capable to do so in the presence of a witness and must contain the appropriate information to make your wishes known.

YourWill lets you to create a Living Will simply and cost-effectively.

As with all other YourWill online documents from Richard Nelson LLP you have the option of creating a Living Will:

 

online but with the security of knowing that your document has been reviewed by one of our wills and probate lawyers,
You draft the document on line by answering a series of questions. As you do so, you will see your Living Will compile itself in the window alongside. Then, at the end, we will:

    • review your answers,
    • deal with any reasonable questions you may have,
    • suggest, where necessary, changes to the way the document is drafted,
    • ensure that the final document is suitable for your requirements based on the answers you gave the system, and
    • send the final version of the document to you to sign and have witnessed.

In the event that you require significant extra work to be done, we will provide you with a quote for the additional work.

by instructing us to prepare the document for you.
If you do not want to use the on line system, or you feel that your circumstances are not suited to the more general on line approach, then we will be happy to provide you with a quotation for dealing with your Living Will for you and drafting it based upon your instructions.
